Purchase Terms
Purchase Terms
Terms applicable to the purchase of plugins, licenses, downloads, updates and support on birlo.es.
1. Seller identification
Trade name: Birlo
Owner: Alberto Tundidor
Tax ID (NIF): 12.390.969-H
Business address: Medio 36, 47191 Ciguñuela (Valladolid), Spain
Email: info@birlo.es
2. Scope and acceptance
These terms govern the purchase of software, licenses, downloads, updates and support marketed by Birlo. Before completing a purchase, the customer must be able to review these terms and expressly accept them where required.
Specific terms shown on each product page, including price, number of authorized installations, license duration or support scope, will prevail over these general terms where they are more specific.
3. Digital products
Birlo products are generally digital content or digital services intended for WordPress and WooCommerce. Delivery is made electronically through the customer account, download links, license keys or other digital means indicated during the purchase process.
4. Prices and taxes
Prices are shown in euros. Applicable taxes will be calculated and displayed during checkout according to the available tax information and relevant legislation.
The final applicable price will be the amount shown before the order is confirmed.
5. Payment methods
Birlo currently allows payment by card, Revolut Pay and, where supported by the device and configuration, digital wallets such as Apple Pay or Google Pay. Actual availability may vary depending on country, device, amount or payment provider.
Payments are processed by external payment providers. Birlo does not store full payment-card details.
6. Order confirmation
After successful payment, the customer will receive electronic confirmation of the order and will be able to access the associated digital items once the order has been processed.
If an obvious error in price, availability or description is detected before the contract is performed, Birlo may contact the customer to correct the error or cancel the transaction and refund the full amount paid.
7. Licenses
Purchasing a commercial product grants a non-exclusive, non-transferable right of use under the terms stated on the product page. The number of authorized websites will be the number included in the purchased plan.
The license allows the plugin to be used on authorized websites while the product terms and applicable law are respected. It does not authorize resale, sublicensing or redistribution of the product as the customer's own product unless expressly authorized.
8. Activetion, domains and site changes
Where a product uses domain- or installation-based activation, the customer may manage the available activations from their account or through the tools provided by Birlo. Activetion limits depend on the purchased plan.
Activetions may be moved between websites provided that the maximum number of simultaneous installations included in the plan is respected.
9. Duration, updates and support
Unless the product page states otherwise, a commercial license includes access to updates and support associated with that license during the contracted period.
License expiration does not automatically disable the installed plugin or delete customer data. After expiration, access to new updates and included support ends unless the license is renewed.
10. Renewals
Renewals extend the period of updates and support under the conditions shown at the time of renewal. If the license is still active, the extension may be added to the existing expiration date where supported by the licensing system.
No automatic renewal will apply unless the purchase process clearly indicates a recurring arrangement and the customer expressly accepts it.
11. Technical requirements and compatibility
The customer is responsible for checking the technical requirements shown on the product page before purchase, including supported WordPress, WooCommerce and PHP versions, as well as any required extensions or services.
Birlo will make reasonable efforts to maintain the compatibility described in the documentation, but cannot guarantee compatibility with every third-party theme, plugin, customization or infrastructure.
12. Right of withdrawal and digital content
Where the buyer qualifies as a consumer, they generally have the right of withdrawal under the conditions established by applicable law.
For digital content not supplied on a tangible medium, the loss of the right of withdrawal will apply only where the legal requirements are met: the consumer has expressly consented to performance beginning during the withdrawal period, has acknowledged that this means losing the right of withdrawal and has received the corresponding confirmation.
If those requirements have not been expressly collected during checkout, this clause does not restrict the consumer's statutory rights.
13. Issues, lack of conformity and refunds
If the digital product is not in conformity with the contract or does not correspond to what was purchased, the customer may request assistance and exercise any rights granted under applicable law.
Refund requests will be assessed taking into account the digital nature of the product, the state of contract performance and the consumer's mandatory legal rights. Nothing in these terms excludes or limits rights that cannot legally be waived.
14. Support
Support covers the product's own functionality within supported versions and environments. Unless separately contracted, it does not include custom development, third-party configuration, general server administration or correction of code not owned by Birlo.
15. Security and lawful use
Licenses and download tools must not be used to distribute unauthorized copies, bypass licensing mechanisms, compromise systems or carry out unlawful activities. Birlo may temporarily restrict access where there are reasonable indications of abuse, fraud or security risk, without prejudice to reviewing the individual case.
16. Changes to these terms
Birlo may update these terms to reflect legal, technical or commercial changes. Purchases already completed will remain governed by the terms accepted when the order was placed, except where changes are mandatory by law.
17. Governing law and dispute resolution
These terms are governed by Spanish law. In contracts with consumers, any clause concerning jurisdiction will apply without prejudice to mandatory consumer forums and rights.
Before starting a formal complaint, you may contact info@birlo.es to try to resolve the issue.
